Acceptance of Terms

By accessing or using the AFreshPet platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using AFreshPet on behalf of a business, you represent that you have the authority to bind that organization to these terms. If you do not agree to these terms, you may not use the platform. We reserve the right to update these terms at any time, and we will notify you of material changes via email or in-app notification.

Account Terms

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date. Each employee account must represent a real individual — shared or generic accounts are not permitted. You must be at least 18 years old to create an account and use the AFreshPet platform.

Payment Terms

Paid plans are billed monthly or annually in advance based on your selected billing cycle. All fees are non-refundable except as required by law or as explicitly stated in these terms. We process payments through Stripe and do not store your full credit card details on our servers. If a payment fails, we will attempt to retry the charge according to our dunning schedule and notify you of the failure. Continued non-payment may result in account suspension.

Platform Fees

In addition to your subscription, AFreshPet charges a platform application fee on every payment you collect from your clients through Stripe Connect. This fee is a percentage of each charge and scales with your subscription plan: 1.5% on the Starter plan, 1.0% on the Growth plan, and 0% on the Scale plan. The platform fee is deducted automatically from each charge at the time it is processed, in addition to Stripe’s standard payment processing fees (for example, 2.9% + 30¢ for US cards) — your payouts arrive net of both. The combined platform fee will never exceed a hard cap of 5% of any single charge. When you upgrade or downgrade your plan, your platform fee rate changes to match your new plan, effective for charges processed after the change takes effect. In some cases we may agree to a custom, negotiated rate that overrides the standard plan rate. Your current effective platform fee rate is always shown on your billing page in your account settings.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your account will remain active until the end of your current billing period. After your subscription expires, your account will be downgraded to read-only mode for 30 days, during which you may export your data. After 30 days, your data will be permanently deleted in accordance with our data retention policy. We may cancel your account if you violate these terms.

Intellectual Property

The AFreshPet platform, including all software, designs, and documentation, is owned by AFreshPet and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your business operations. You retain full ownership of all data you upload to the platform. We do not claim any intellectual property rights over your client data, photos, or business information.

Limitation of Liability

AFreshPet is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, AFreshPet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
